Please be aware that if the country of delivery is not part of the European Union, products are invoiced excluding taxes and customs duties will apply. Delivery times are provided as guidelines only, and do not take into account possible delays caused by payment authorization. We are unable to deliver to post office boxes.

 

 

2/ RETURN

 

You have fifteen days to return your purchases to us free of charge (only from Metropolitan France. Returns from abroad are at your expense) and receive a full refund. Items must be returned unused and in their original packaging (items should not be used, suffer any deterioration however slightly and be in perfect cleanliness).

 

To do so:

  1. Please contact G.ALAIX Customer Service directly at the address contact@g-alaix.com. Please tell us your name and order reference, and if you want an exchange or a refund. Or by your client account on the Website (section “History and details of my orders”). During the return process, the Customer shall select the product(s) to be returned, chose whether it shall constitute an exchange or refund, and specify the return motive. The inquiry is then submitted for validation by G.ALAIX, who will notify its agreement to the Customer by e-mail.

2. We will send you a return shipping label (pre-payed) by email. Print it and place it on the box.

3. We will send you a confirmation e-mail as soon as the return is done, and will proceed with the exchange or refund.

 

Exchange:

 

Exchanges will only be accepted if the price of the initially ordered products matches the price of the requested products in replacement.  Should this not be the case, G.ALAIX cannot validate the exchange inquiry. All exchanges are based on stock availability and are shipped to you free of charge. Sale items are non-exchangeable but can be returned for a full refund.

 

Refund:

 

Once we have received the parcel you will be refunded within 15 business days via the account used for payment.

 

Electronically credited invoice cannot be used on the Website and will not be delivered to the Customer under any circumstances by G.ALAIX.

 

How to make an order ?

 

1. Click on the « Shop » tab and select a product in the left hand row. Then click on the color of your choice in order to accede to the product page.

2. Add the product you like to your shopping basket by clicking on « Add to cart ». 

3. When you have finished shopping, click on your shopping basket, create a personal account and then follow the instructions.

4. This will complete the ordering process. A confirmation e-mail will be sent to you.

The general terms of sale (« Terms ») apply to all orders placed on the website www.g-alaix.com (the « Website ») for the purchase of products (« Products ») presented on the website by the company G.ALAIX.

G.ALAIX SASU with a capital of 30 000€ is located at 15 rue george sand 75016 Paris, registered with the RCS Paris under number 803 163 385, VAT number FR 79 803 163 385. 

All orders of Products offered on the Website imply the express acceptance of these Terms.

The French version of these Terms is the one which prevail.

 

Order

 

The orders are carried out exclusively on the site.

The resale or distribution of products purchased on the Website is strictly forbidden. 

The so called “double click” process associated with the authentication of the procedure and its non repudiation, and the protection of message integrity, constitutes an electronic signature, which has as much value between the parties as a handwritten signature.

G.ALAIX reserves the right to refuse any orders placed by Clients who have not paid a previous order.

Products remain the property of G.ALAIX until full payment. Risks shall be transferred to the Client upon the start of the delivery.

The Client must verify completeness and conformity of the information provided when ordering. G.ALAIX cannot be held liable for any eventual input errors when filling up forms. Eventual further expenses required for the reshipment will thus be charged to the Client.

 The Client can modify or cancel the order solely by filling de contact form or by e-mail (contact@g-alaix.com), before shipping of the package.

 

Availability

 

The products and prices offered are valid as long as they are visible on the site, subject to availability.

In the event that an ordered product proves to be unavailable, the Client will be notified by e-mail. G.ALAIX will offer the Client to substitute the unavailable product by another product of the same price or to cancel the order which leads to the refund of the cancelled product. In that case, G.ALAIX will refund the Client within a 15 business days.

 

Price

 

The products are invoiced on the basis of the displayed prices on the Website at the time the order is placed. G.ALAIX shall modify the prices of the products offered on the Website at any time. However the products will be invoiced on the basis of the tariffs in force when the order is recorded.

The prices displayed on the Website are in Euros all taxes included (for France and the EU countries). The prices given do not include the delivery costs. This cost will be invoiced in addition and specified before the order is confirmed. The price of products dispatched outside the European Union will be calculated net of tax. Custom duties, import taxes or others formalities are the responsibility of the Client.

 

Terms of payment

 

The orders made on the Website are payable in Euros by credit card (CB, Visa, MasterCard).

Processing and shipping of the order will occur only after verification of payment and reception of authorization by banking organizations.

Products are delivered to the delivery address provided by the Customer during the order process. G.ALAIX cannot be held liable for any input errors during form filling and their consequences in terms of delivery time or errors. In this context, all extra costs for reshipping shall be borne by the Customer. G.ALAIX cannot be held liable for overly long delivery time caused by the unavailability of the recipient or in case of absence of withdrawal during the given period.G.ALAIX cannot be held liable for overly long delivery time due to errors or disruption imputable to the Transporters.

 

Withdrawal

Product display

 

The photographs and texts reproduced and illustrating the products do not fall within the scope of the contract. The Client is advised to refer to the description of each product to know the precise characteristics. G.ALAIX’s liability may not be held in connection with any error from one of these photographs or texts. 

All products sold on the Website are subject to the following statutory warranties:

 

Article 1641 of the Civil Code 

The vendor is subject to the warranty against hidden defects in the sold product rendering it unfit for its intended use, or which so impair such use that the purchaser would not have bought it or would have paid a lower price, had the purchaser been aware of the defect(s).

 

Article 1648 of the Civil Code

The action based on redhibitory defects must be brought by the purchaser within a period of two years following discovery of the defect. In the case provided for in Article 1642-1, the action must be brought, under pain of

being time-barred, within the year following the date on which the seller may be discharged from patent defects.

 

Article L211 -4 of the French Consumer Code

The vendor is required to deliver a product that complies with the contract and shall be liable for any non-compliances existing upon delivery. The vendor shall also be liable for non-compliances resulting from the packaging, the assembly or installation instructions where the vendor is liable under the contract for assembly/installation or where it was carried out under the vendor’s responsibility.

 

Article L211 -5 du Code de la Consommation 

To comply with the contract, the product must: 

1. Be fit for the use normally expected of an item of its type and, where appropriate: correspond to the description given by the vendor and have all the qualities presented to the purchaser by the vendor in the form of a sample or model; have the qualities that a purchaser can legitimately expect given the public statements made by the vendor, producer or his representative, in particular in advertising or labeling; or 

2. Have the characteristics defined by mutual agreement by the parties or be fit for all special uses sought by the purchaser which the vendor was made aware of and accepted.

 

Article L211-12 du Code de la Consommation

Legal action based on non-compliance is time-barred two years after the delivery of the product 

 

Intellectual and industrial property

 

The Website, including (but not limited to) text, content, software, video, music, sound, graphics, photographs, illustrations, artwork, photographs, names, logos, trademarks, service marks and other material are the property of G.ALAIX. In application of the French Intellectual property Code, total or partial reproduction by any process whatsoever and/or distribution, publication, modification, sell of the partial or entire Website, or creation of derivatives from the Website, by third parties are strictly forbidden.

 

Personal data

 

G.ALAIX guarantees to not divulge to any third parties, personal information that is collected within the scope of distance selling. Such personal information is strictly confidential. The information and data concerning the Client is strictly necessary for order management, implementation and monitoring of business relationships.

In accordance with the Law of January 6, 1978, Website users are entitled to access, modify, correct and delete data concerning them. 

 

Responsibility

 

G.ALAIX shall in no event be liable to the User or any third parties, by way of indemnity or by reason of any breach of the contract or in tort or for loss of production, loss of profit or loss of any contract, or for any indirect, special or consequential loss or damage that may be suffered by the User in connection with the incorrect use of the sold goods. 

The limitations of liability also apply to any suspected modifications of products from the suppliers.

The company G.ALAIX may retain the right to reject an order following a computer bug, error in the filling of the forms, hacker attacks or any internal or external malevolence. G.ALAIX shall inform the Customer of the order cancellation.

You acknowledge that your use of the Website, including the content is at your own risk. If you are dissatisfied with the Website, the General Terms of Sale or General Terms of Use or any of the content your sole remedy is to discontinue use of the Website

 

Applicable law

 

In the event of a dispute, the Client will address G.ALAIX for an amicable resolution. 

The contract formed by acceptance of these Terms is subject to French law.The language of this contract is the French language. In case of dispute, French courts will have jurisdiction.
